Rules for child transportation in cars

Child transportation in cars can be challenging. It requires attention, preparation and planning ahead, but there is another key factor: safety. In this regard, Common sense matters, but above all it is essential to comply with the law - namely the Highway Code.

To clarify any legal questions, it is important to consult Article 55 of the Highway Code. Xtracars summarises the main precautions to take when transporting children in cars.

Child road safety: rules for transporting children up to the age of 12

Children under the age of 12 and under 135 cm tall must travel in the rear seats, using an approved child restraint system suited to their size and weight.

However, the law allows exceptions in specific cases: they may travel in the front passenger seat, provided they are secured in an appropriate child restraint system and always positioned rear-facing.

This rear-facing position is recommended to minimise to reduce the risk of neck and other injuries in the event of an accident. When a child travels in the front seat in a rear-facing position, the front passenger airbag must be deactivated.

In cases where the rear seats are not fitted with seat belts, children aged 3 and over may travel in the front seat, the applicable safety rules are followed. Children under the age of 3 must never be transported in these circumstances.

How to transport multiple children in a car


In larger families, or when transporting children’s friends, it is advisable to choose a car with enough interior space.

Regardless of this factor, there are important points to consider. When transporting three children under the age of 12 and under 135 cm tall, if one of them is over 3 years old, that child may travel in the front seat. Even in this scenario, all mandatory safety rules must be followed, namely the use of an appropriate child restraint system.

In a situation involving four children, all under 12 and under 135 cm tall, the tallest child who is over 3 years old may travel in the front seat using a seat belt.
Finally, in vehicles without seat belts, children under the age of 3 must not be transported.

Transporting children with disabilities is also subject to clearly defined rules in the Highway Code. In these cases, restraint systems must meet the child’s specific needs and be prescribed by a medical specialist.
